Peter Le Guay, Partner, Thomsons Lawyers

Peter Le Guay is a partner in the corporate department of Australian law firm Thomsons Lawyers and specialises in advertising and intellectual property law. With over 20 years’ experience, Peter has a broad range of commercial experience and can advise on all legal aspects of promotional marketing, whether it be advising on trade promotions, advising clients on marketing campaigns and ad copy, or dealing with intellectual property, privacy or spam issues.

Peter regularly advises clients in respect of their trade promotions conducted in Australia, whether the promotions are conducted multi-jurisdictionally or specifically in Australia. He provides advice on both games of skill and trade promotion lotteries (sweepstakes), including drafting and reviewing official rules, release forms and collateral advertising material as well as providing advice on the complex regulatory and licensing requirements applicable in each State and Territory of Australia.

Peter understands online and digital marketing, and regularly provides advice in respect of Australian privacy and spam issues including in relation to privacy policies, website terms of use, behavioural advertising, use and transfer of data and electronic direct marketing. He also maintains a large trade mark portfolio and provides advice on a range of intellectual property issues, including trade mark issues and copyright issues which may arise in the context of user generated content.

Peter also provides advice in respect of marketing claims and consumer law, including review of ad copy and representation of clients in respect of marketing claims before the Australian Competition Consumer Commission (ACCC), Advertising Standard Board, industry specific complaint panels and the Federal Court.

Peter is responsible for the firm’s membership of the Global Advertising Lawyers Alliance (GALA) and is the current president of the Asia-Pacific region.
